Patient Responsibility Statement

By submitting this consultation form I affirm as if under oath and state truthfully that I am a competent adult at least 18 years of age. I am permitted by law in my locale to receive the medication(s) I am requesting for my personal medical and therapeutic purposes.

I, the patient, have had a satisfactory and sufficient physical examination and medical history evaluation by my personal family physician within the last 6 months who is available and whom I agree to contact for any necessary local follow-up care and intervention, in case I have any difficulties, possible complications, or questions. I know also that I may contact the prescribing physician and the dispensing pharmacy, and I will keep those toll free numbers available.

I have been fully informed by appropriately trained health care personnel and understand the risks, benefits, and possible side effects of the prescription drug(s) I may request, I have studied written or internet materials on these drugs including the websites and links that offer in-depth material.

I also affirm that I have previously safely used the medication(s) I may request, under a physician's supervision, or I have been advised by my examining physician that the use of the medication(s) is not contraindicated for me and is appropriate for my personal therapeutic and medical needs.

I am requesting the prescription medication(s) solely for my own personal therapeutic and medical needs, and will not distribute any of the medication to others. I am requesting that an Indian licensed prescriber acts only in an adjunct capacity to my local physician, and not replace my local physician, when reviewing my request. I further request the prescriber to authorize the prescription drug(s) for dispensing by the clinic's associated licensed pharmacy. I affirm that I am seeking the prescription(s) for a necessary supply of medication, not to stockpile beyond an already adequate supply on hand. I will promptly contact a local physician for any necessary medical intervention should a complication or concern result related to the use of a requested medication.

I agree not to take any over-the-counter medicines without approval from my pharmacist.

I agree to monitor my blood pressure at least once every 14 days. If my blood pressure is over 140/90 (either the top number is greater than 140 or the bottom number is greater than 90), I agree to stop taking this medication immediately.

I am allowed by law to use the credit card that will be used if my request is approved and processed.

I affirm that I have answered and will answer all questions truthfully, for my safety, just as I would in my local physician's office and under that physician's care, I have fully and completely disclosed any and all information concerning my health and medical history that might possibly be relevant to my request for this medication.

I realize there are risks as well as benefits to any medication, even OTC drugs. I have been fully informed of the effects, risks, and benefits of this medication. I agree that I have been previously and recently examined sufficiently as to physical and medical condition, and I have been provided sufficient information and adequately understand, the same as or more than if this consultation had taken place with my local physician in a physical office setting.

I am soliciting this site because I am seeking a specific prescription medication to treat an already-identified medical or cosmetic condition; I acknowledge and agree that I, under no undue duress, initiated contact with Shopeastwest.

I am under the care of a primary care physician and I do not consider the Consulting Physician to be my primary care physician (unless I visit said physician for an in-person personal doctor/patient consultation). I will not rely on or substitute the advice given by the Consulting Physician should it contradict the advice given to me by my primary care physician; I will not make a claim that the Consulting Physician acted unprofessionally or below the standard of care; The Consulting Physician reviewing my “Medical History/Personal Profile Questionnaire” will make a decision based upon my honest responses in making his or her decision regarding my request. I am under the care of a primary care physician. I understand all the information provided is truthfully, accurately and complete. I also understand that failure on my part to provide truthful, accurate and complete information may cause me physical or mentally harm. To prevent this occurrence, I acknowledge that it is of utmost importance that I am truthful; Before taking any medication prescribed, I will ensure that I have completed the following: accurately and honestly completed a comprehensive physical examination by my primary care physician; that I received a copy of the written report of said examination. Shopeastwest does not practice medicine. I understand Shopeastwest is a Management Service Organization that received my request for prescription medication and, in turn, directs that request to a qualified independent pharmacy for review and response. The pharmacy who reviews my valid prescription and then who makes the medical determination as to whether or not I receive the medication. I am seeking is solely an independent contractor of Shopeastwest and is not an agent or employee of Shopeastwestor its affiliates.

Registration; Customer Accounts; Use of Site. Certain services offered on or through the Site require you to first open a My Account. Consent To Our Communication With You By E-Mail. By establishing a My Account with us, and each time you make a purchase through our Site, you grant permission for Shopeastwest to contact you at your e-mail address. To stop receiving our marketing emails, send an e-mail to us at http://support.medhubonline.com or follow the opt-out procedures set forth in such marketing emails.

Conditions of Sale and Payment Terms.Any transaction on this site shall be deemed valid only under the following conditions: (1.) Your age should be eighteen (18) years or more, or you should be considered as an adult that can carry out financial transactions in the country of your residence. (2.) You should be an individual, natural human being (should not be a collective like a corporation or any similar legal entity), and (3.) you should be a resident/citizen in the country of Order. You agree to pay all fees and charges incurred in connection with your purchases (including any applicable taxes) at the rates in effect when the charges were incurred. Unless you notify Shopeastwest of any discrepancies within sixty (60) days after they first appear on your credit card statement, you agree that they will be deemed accepted by you for all purposes. If Shopeastwest does not receive payment from your credit card issuer or its agent, you agree to pay all amounts due upon demand by Shopeastwest or its agents. You are responsible for paying any governmental taxes imposed on your purchases, including, but not limited to, sales, use or value-added taxes. Shopeastwest shall automatically charge and withhold the applicable sales tax for orders to be delivered to addresses within California and Massachusetts and any other states or localities that it deems is required.

Order Acceptance Policy. Your receipt of an electronic or other form of order confirmation does not signify our acceptance of your order, nor does it constitute confirmation of our offer to sell. Shopeastwest reserves the right at any time after receipt of your order to accept or decline your order for any reason. Shopeastwest further reserves the right any time after receipt of your order, without prior notice to you, to supply less than the quantity you ordered of any item. Your order will be deemed accepted by Shopeastwest upon our delivery of products or services that you have ordered. All orders placed over $1000.00 (U.S.) must obtain pre-approval with an acceptable method of payment, as established by our credit and fraud avoidance department. We may require additional verifications or information before accepting any order. Shopeastwest is a reseller to end users and does not accept orders from resellers, exporters, wholesalers, any businesses of any kind or other customers who intend to resell.

No Responsibility To Sell Mispriced Products Or Services. Shopeastwest shall have the right to refuse or cancel any orders placed for products and/or services listed at an incorrect price, rebate or refund, or containing any other incorrect information or typographical errors. Shopeastwest shall have the right to refuse or cancel any such orders whether or not the order has been confirmed and your credit card charged. If your credit card has already been charged for the purchase and your order is canceled, Shopeastwest shall immediately issue a credit to your credit card account in the amount of the charge.

Modifications to Prices or Billing Terms. Shopeastwest RESERVES THE RIGHT, AT ANY TIME, TO CHANGE ITS PRICES AND BILLING METHODS FOR PRODUCTS OR SERVICES SOLD, EFFECTIVE IMMEDIATELY UPON POSTING ON THE SITE OR BY E-MAIL DELIVERY TO YOU.

Indemnification. You agree to indemnify and hold harmless Shopeastwest and its parents, sister companies, subsidiaries, affiliates, service providers, other End Users, distributors, licensors, officers, directors and employees from any claim or demand, including reasonable attorneys' fees, made by any third party arising out of or related to your violation of this Terms of Use, or your violation of any law, regulation or third-party right.

LIMITATION OF LIABILITY. THE ENTIRE RISK ARISING OUT OF THE USE OF THE SITE, THE USE OF ANY PRODUCTS AND/OR SERVICES OFFERED ON OR IN CONNECTION WITH THE SITE, AND/OR THE USE OF ANY CONTENT REMAINS WITH YOU. IN NO EVENT SHALL Shopeastwest OR ITS LICENSORS OR ANY OF THEIR OFFICERS, DIRECTORS, EMPLOYEES, AGENTS OR AFFILIATES BE LIABLE FOR ANY CONSEQUENTIAL, INCIDENTAL, DIRECT, INDIRECT, SPECIAL, PUNITIVE, OR OTHER DAMAGES WHATSOEVER (INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF BUSINESS PROFITS, BUSINESS INTERRUPTION, LOSS OF BUSINESS INFORMATION, OR OTHER PECUNIARY LOSS) ARISING OUT OF THIS TERMS OF USE OR THE USE OF OR INABILITY TO USE ANY PRODUCTS, SERVICES, CONTENT AND/OR DIGITAL DOWNLOADS, WITH THE DELAY OR INABILITY TO USE THE Shopeastwest SITE OR RELATED SERVICES, THE PROVISION OF OR FAILURE TO PROVIDE PRODUCTS OR SERVICES, OR FOR ANY INFORMATION, SOFTWARE, PRODUCTS, SERVICES AND CONTENT OBTAINED THROUGH THE SITE, OR OTHERWISE ARISING OUT OF THE USE OF THE Shopeastwest SITE WHETHER BASED ON CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY OR OTHERWISE EVEN IF Shopeastwest HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. NOTWITHSTANDING ANYTHING ELSE IN THIS TERMS OF USE OR POSTED ON THE SITE, THE MAXIMUM LIABILITY THAT Shopeastwest SHALL HAVE IS LIMITED TO ANY AMOUNTS ACTUALLY PAID TO Shopeastwest BY END USER. YOU ASSUME ALL RISK OF LOSS FOR SHIPPED PRODUCTS. ORDER INFORMATION SUCH AS BILLING OR SHIPPING ADDRESS THAT IS INACCURATE OR INCOMPLETE MAY RESULT IN DELAYS THAT SHALL NOT BE THE RESPONSIBILITY OF Shopeastwest. Policy to Terminate Privileges for Copyright Infringement. Pursuant to 17 U.S.C. § 512 as amended by Title II of the Digital Millennium Copyright Act (the "Act"), Shopeastwest Inc. will terminate the account of any customer, or vendor who uses his or her privileges to unlawfully transmit copyrighted material without a license, valid defense or fair use privilege to do so. After proper notification by the copyright holder or its agent to the Shopeastwest and later confirmation through court order or an admission by the customer that an account has been an instrument of unlawful infringement, Shopeastwest will terminate the infringing customer's account. Shopeastwest may also in its sole discretion decide to terminate a customer's account privileges prior to that time if it has good belief that infringement has in fact occurred. In addition, pursuant to 17 U.S.C. § 512(c), Shopeastwest has implemented procedures for receiving written notification of claimed infringements and for processing such claims in accordance with the Act. Shopeastwest respects the intellectual property of others and we ask other to do the same. If you believe that your copyright has been infringed through the Shopeastwest website, please contact "Legal Department", via email http://support.medhubonline.com Any written notice describing the infringing activity must include the following information:

An electronic or physical signature of the person authorized to act on behalf of the owner of an exclusive that is allegedly infringed;

A description of the allegedly infringing work or material; A description of where the allegedly infringing material is located on the site; Information reasonably sufficient to allow us to contact you, such as your address, telephone number and e-mail address; A statement by you that you have a good faith belief that the disputed use of the material is not authorized by the copyright or other proprietary right owner, its agent, or the law; and A statement by you that the above information and notification is accurate, and under penalty of perjury, that you are the copyright owner or authorized to act on behalf of the owner whose exclusive right is allegedly infringed.

General. No delay or failure to take action under this Terms of Use shall constitute any waiver by Shopeastwest of any provision of this Terms of Use. If any provision of this Terms of Use is invalid or unenforceable under applicable law, it is, to that extent, deemed enforceable to the fullest extent possible (and severable in the event such provision is completely unenforceable) and the remaining provisions of this Terms of Use will continue in full force and effect. This Terms of Use will bind and inure to the benefit of Shopeastwest 's permitted successors and assigns. Any claim under these Terms of Use must be brought within one (1) year after the cause of action arises. This Terms of Use shall be governed by the laws of the State of New York without regard to or application of any conflict of laws provisions. You consent to the exclusive jurisdiction of the state and federal courts sitting in New York County, in the State of New York. This Terms of Use is personal to you and may not be transferred, assigned or delegated to anyone. Any attempt by you to assign, transfer or delegate this Terms of Use shall be null and void. Shopeastwest may freely assign this Terms of Use without consent or notice. This Terms of Use (including all documents expressly incorporated herein by reference, including but not limited, to the relevant Usage Rules) constitutes the complete and exclusive agreement between Shopeastwest and you with respect to the subject matter hereof and supersedes all prior oral or written understandings, communications or agreements not specifically incorporated herein.
